GIROUX GLASS, INC. PURCHASE ORDER TERMS AND CONDITIONS FOR SERVICE DEPARTMENT

  1. When handling a customer’s hardware and/or glass (other than Giroux Glass’ own), Giroux Glass assumes no responsibility for any accidental damage that may occur.
  2. No warranty is provided on repairs, including caulking repairs.
  3. No warranty is provided on tampered or abused material, hardware and/or glass. No warranty on new glass is provided, for breakage of any kind, after new glass has been installed, unless IGU’s have failed and are still under warranty.
  4. No permits or bonds are included in the proposal unless stated in its description.
  5. Giroux Glass requires that the perimeter of each floor and the ground level of the building be cleared of all stored material and debris for a distance of ten (10) feet, in order to allow movement, assembly, storage and installation of materials. The ground is to be reasonably level and free of trenching or other obstructions.
  6. Giroux Glass will remove perimeter barricades for installation of its materials, provided such barricades are readily removable at columns, and turnbuckles are used at corners.
  7. No additional work will be performed on-site unless the customer or Owner notifies Giroux Glass in writing, and Giroux Glass directs management personnel to perform such work. Any additional work will be charged on a time and material basis.
  8. Matching glass, hardware finish, and/or film will not always be an exact match, unless specifications are provided by the customer. Materials will be furnished in accordance with published industry standard tolerances for color variation, thickness, size, finish, texture and performance standards.
  9. Giroux Glass is not responsible for marking, taping, or masking of glass or metal, or for removal of the same after their installation.
  10. No shop drawings or structural calculations are included, unless so stated in project description.
  11. Oversized glass will contain small amounts of defects, blemishes, distortions and/or bows, due to the tempering process.
  12. Should the project be delayed through no fault of Giroux Glass, and cause a delay in requirements of its materials, a review of the effect on the price and delivery will be made. Such a delay will be considered as justifiable cause for an adjustment to either or  both the price and delivery.
  13. Acceptance of Giroux Glass work is to be completed by a mutually agreed-upon method (i.e. installation of materials). Giroux Glass will not be responsible for damage after the work is installed and accepted.
  14. Giroux Glass will not be required to install any materials under unfavorable or unsafe weather conditions.
  15. Giroux Glass does not accept responsibility for any liquidated damages, whether assessed by Owner to Contractor, or otherwise, or for any indirect or consequential damages.
  16. Giroux Glass, Inc. will not be obligated under this proposal/estimate/quote to indemnify the Contractor, Owner, or Architect, with respect to any occurrence or accident, which is caused by the sole negligence or willful misconduct of Contractor, Owner, or Architect, their agents or servants, or other third parties.
